The 2009 KEEN AS CUP winners

 

1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2. Entry is open only to Australian residents excluding directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition.
3. The competition begins at 9.00am (AEDST) on 23/11/09 and closes at 11.59pm (AEDST) on 23/12/09 (or at a later date as determined and specified by the Promoter) (Competition Period).
4. Entrants must, during the Competition Period, visit www.keensmustard.com.au (Website) and upload an image (limit 2MB in .jpeg or .gif format) of, either:
   (a) their home decorated in Christmas lights; or
   (b) another Australian residential home decorated in Christmas lights,
   (Entry), and fully complete and submit the online entry form including their full name, age, suburb, postcode, email address, gender and contact phone numbers (and any other details as required by the Promoter).
5. Once the Promoter has viewed the Entry and deemed it acceptable (in its absolute discretion), the Entry may be placed on the Website along with the entrant's first name and suburb. The Promoter is not liable for any technical difficulty or error that results in any Entry being wholly or partly unavailable for online access, for any period of time.
6. By entering, entrants acknowledge that their Entry (and their first name and suburb) may be made available online by the Promoter (in its absolute discretion) and may be accessible to the general public. The Promoter may copy, in part or in its entirety, the Entry, cause the Entry to be seen in public, and communicate the Entry to the public. It may also allow third parties to do these things.
7. Entrants may enter as many times as they wish provided that each Entry is based on a separate Entry containing a different photo. Each Entry must be received during the Competition Period. Entries must not contain images of third party trade marks or brands. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected Entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, networks, lines or the Internet and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
8. Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter's discretion. This is a game of skill; chance plays no part in determining the winners. Each Entry will be individually judged (by representatives of the Promoter) based on, among other things, creativity and "keenness". The judges decision is final and no correspondence will be entered into.
9. The entrant assigns all rights (including copyright) in each Entry to the Promoter at the time of submitting an Entry. By entering this competition entrants:
   (a) consent to the Promoter making copies of or publishing the whole or any part of their Entry and otherwise exploiting the Entry and any rights in relation to the Entry, to publicise this competition, the Promoter's products or for any other purposes;
   (b) undertake to the Promoter that their Entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights; and
   (c) consent to any act by the Promoter in relation to their Entry which would otherwise infringe their moral rights in the content of the Entry.
10. Once submitted, entrants cannot alter or delete their Entry without prior approval from the Promoter. Entrants can contact the Promoter at the address in paragraph 26 in relation to altering or deleting their Entry.
11. The Promoter, in its absolute discretion, may edit any part of an entrant's Entry. By entering, entrants agree to the Promoter editing, amending, making an adaptation of or otherwise varying the whole or any part of their Entry.
12. By entering this promotion, the entrant warrants that each Entry:
    (a) is original and not copied, and was created by the entrant;
    (b) does not include any image of any other person without that person's express consent;
    (c) does not include any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. Without limitation, entrants must not include any content that involves nudity, malice, or which may be defamatory or in contempt of court;
    (d) does not include any work or other item in which copyright subsists (Copyright Content), unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any Copyright Content in their Entry, they must not include it. By including any Copyright Content in their Entry, the entrant warrants that they are entitled to do so; and
    (e) contains no viruses or other computer code or material embedded in it which may have a negative impact on the Website, this competition or any network or third party computer systems.
13. The Promoter may (but is not obliged to) at any time reject and/or remove from access by the public or disqualify or invalidate any Entry that it considers (in its sole judgment) infringes these terms and conditions. The Promoter will have no liability to entrants in that regard.
14. At the end of the Competition Period, the best valid Entry received relating to an entrant's own decorated home and the best valid Entry received relating to another person’s decorated residential home will each win a prize. There are 2 prizes to be won. Each prize is a Sunbeam prize pack consisting of a GB2100 Innovo 2 Burner Gas BBQ, a FP8910 Ellise Stainless Banquet Frypan, a WW7500D 7.5L Wok and a DF8300 Ultra Deep Fryer. Each prize is valued at $1,000 (inc GST). The total prize pool is valued at $2,000 (inc GST).
15. The winners will be notified by email.
16. The winners must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
17. The prizes will be delivered to the winners at their nominated address. The Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
18. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
19. The Promoter may require the winners to provide proof of identity and proof of residency. Identification considered suitable for verification is at the Promoter's discretion.
20. The Promoter may, in its sole discretion, disqualify all Entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
21. The prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
22. Each prize must be claimed by 25/01/10. If a prize remains unclaimed by that date, that winner's entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry (within the same photo category).
23. If for any reason any aspect of this competition is not capable of running as planned, including, but not limited to, by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected Entries.
24. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
25. All Entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. If the entrant has marked the "opt-in" box on the online entry form, the entrant consents to the storage of their personal information on the Promoter's database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter's products including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter via email to marketing_australia@mccormick.com.
